PATTAYA PEOPLE PROSECUTED CHONBURI GOVERNOR

At the Central Administrative Court, located on Chaengwattana Road, Late morning of November 23rd, 2010, 61 Residents of Jomtien and Pattaya Municipality of Chonburi Province lodged a prosecution to sue the Chonburi Governor for "Misappropriation of Conduct" which permitted or allowed the View Talay Condominium (1999) Co., Ltd to construct many permanent condominium projects close to each otherin Nongprue area of Banglamung District of Chonburi province which were constructed too close to the sea and within the 200 meters of "Move Back Reserved Distance".

The people also deemed that the Environmental Impact Assessment Report was not done correctly and properly by the patterns and steps of law as it showed the lack of participation of the people who were the Interested Persons of this matter in community which considered to be in infringement with the rights of people in the community.

The Prosecutors requested the Administrative Court to revoke the construction licenses and demolition of the building parts which are in violation with the law and cancelling the EIA Report or Activities of both View Talay Jomtien Condominium and View Talay Pattaya Beach Condominium of View Talay Condominium (1999) Co., Ltd as well Projects 5,6 and 7. "

Pattaya Mayor Responds to Stop Global Warming Association Court Filing : Click on me~







The news conference at Pattaya City Hall today was well attended by over 30 journalists from newspapers and national tv media. The mayor reported on the the Stop Global Warming Association and it's Director Mr. Srisuwan Janya law suit at Central Administrative Court located in Jaeng Wattana District of Bangkok. This is an ongoing legal case that is of major national interest and it should not be construed that View Talay Jomtien Beach Condominium acted incorrectly. But they may find themselves a big problem if the Pattaya City Hall is found to be in violation of Interior Ministry Regulations Issue 9. The court is being asked to revoke the Construction License of View Talay Jomtien Beach Condominiums. Also, It's my understand this suit is asking for the demolishing all parts of the questioned buildings over fourteen meters (46 feet) high.

They’re been a lot of attention being given to this court filing. This legal action has just begun and there will be many court hearings in the future, which, we will keep you informed.

Thailand Global Warming Association Files New Suit. Click on me~


Today was a historical day in Bangkok. Srisuwan Janya chairman of Thailand’s Global Warming Association (NGO) with others Thais files court case in Bangkok Administrative Court. I was invited to witness this historical action in the making. My understanding this suit is asking the government to demolish all parts of VT7 over 14 meters in hight. More will be posted after I receive an English translation of today court case.

Thai Environmental Interest in Pattaya Seashore

We have been inform that a Thai legal groups in Bangkok will enter a new case against Pattaya City Hall over their violation of Thailand Ministerial Regulation No. 8 and 9. We expect the new legal case to be filed in July! More news will follow and we will translate and post any new legal filings.
We are thankful for Thai’s environmental interest in the Ministerial Regulation No. 9 and to restore the Pattaya’s coastline to the original intent. The Thai legal association in April sent a notification letter to Pattaya City Government of their supposed violations of Thai law. They can file a lawsuit in Administrative Court if the city doesn’t take action with in 90 days to correct the violation of Ministerial Regulation No. 8 and 9.
